Engagements & Client Agreements

Service engagements are governed by a separate Client Agreement, including scope, deliverables, fees, and performance obligations. In case of conflict, the Client Agreement controls.

Payments & Refunds

Unless stated otherwise in the Client Agreement, fees are due in advance and non-refundable once work begins.

Disclaimer

Marketing results vary by market and execution. We do not guarantee specific outcomes unless expressly stated in writing.

Limitation of Liability

To the maximum extent permitted by law, our total liability for claims related to the site or services is limited to the amounts you paid in the 3 months preceding the claim.

Confidentiality

Each party will protect the other's confidential information and use it only as needed to perform under the applicable agreement.

Intellectual Property

We retain all rights to our pre-existing materials, processes, and content. You retain rights to your brand assets and data.

Governing Law & Disputes

These Terms are governed by the laws of the State of New York, without regard to conflict of law rules. Venue for disputes will be in state or federal courts located in New York.
